Welcome to Paul Kaye Photography. These Terms of Service govern your use of our website and photography services. By booking our services or using our website, you agree to these terms.
1. Photography Services
Paul Kaye Photography provides professional wedding photography services in Melbourne, Yarra Valley, Mornington Peninsula, and surrounding areas. All services are subject to availability and require advance booking.
- Coverage times are calculated consecutively from the agreed start time
- Travel beyond 25km from Melbourne CBD is charged at $5 per kilometre
- Additional hours are charged at $350 per hour
- All packages include GST and are quoted in Australian Dollars (AUD)
2. Booking & Payments
To secure your wedding date, a non-refundable retainer of 30% of the total package price is required. The remaining balance is due 7 days prior to the wedding date.
- Payments can be made via bank transfer or credit card
- All retainers are non-refundable in the event of cancellation
- Date changes are subject to availability and may incur additional fees
3. Cancellations & Postponements
If you need to cancel or postpone your wedding:
- Cancellations made within 30 days of the wedding date forfeit all payments
- Postponements must be requested in writing at least 30 days in advance
- We will make reasonable efforts to accommodate date changes, subject to availability
- If we are unable to accommodate a postponement, standard cancellation terms apply
4. Image Delivery & Copyright
We take pride in delivering high-quality images that capture your special day:
- Digital galleries are delivered within 2-4 weeks of the wedding date
- All delivered images are edited for colour consistency and exposure
- Paul Kaye Photography retains copyright of all images captured
- Clients receive a personal use license for all delivered images
- Images may not be sold or used for commercial purposes without written permission
- We reserve the right to use images for portfolio, website, and marketing purposes
5. Image Archive
Your online proof gallery remains active for 9 months from the delivery date. After this period, images may be archived and additional fees may apply for reactivation. We recommend downloading and backing up your images promptly.
6. Client Responsibilities
To ensure the best possible outcome:
- Clients should provide a detailed timeline at least 2 weeks prior to the wedding
- Meals should be provided for the photographer during coverage exceeding 5 hours
- Safe working conditions must be provided at all venues
- Client cooperation with group photo arrangements is required for efficient coverage
7. Limitations
While we strive for perfection, we cannot guarantee specific shots or outcomes:
- We are not responsible for missed shots due to client tardiness or timeline delays
- Outdoor photography is weather-dependent; we will make best efforts in all conditions
- We are not liable for venue restrictions that limit photography opportunities
- Equipment failure is extremely rare, but in such cases, we will provide proportional compensation
8. Privacy
Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal information.
9. Governing Law
These Terms of Service are governed by the laws of Victoria, Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Victoria.
10. Changes to Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of our services following any changes constitutes acceptance of those changes.
